New Policy Implemented Under High Court Directions

The Uttar Pradesh government has instituted rigorous character verification guidelines for candidates selected through direct recruitment for state government positions, public sector corporations, local bodies, and councils. Issued by Principal Secretary of the Appointment and Personnel Department M Devaraj, the updated policy complies directly with directives issued by the Allahabad High Court.

Under the revised framework, individuals found to have active affiliations with organizations whose stated objectives include achieving political or social transformation through violent means will face strict disqualification from public employment. The regulation specifically targets activities occurring within the three-year window preceding the verification date, provided the candidate had attained 21 years of age.

However, the administration has incorporated safeguards to protect candidates from arbitrary rejection. The guidelines explicitly state that a mere political ideology, by itself, cannot serve as grounds for denying employment. Furthermore, the registration of a First Information Report (FIR) or a pending police investigation will not automatically disqualify an applicant. Individuals who have been officially acquitted, resolved matters through legal compromise, or fallen under the purview of juvenile justice laws remain protected from automatic rejection.

Safeguards and Review Provisions

The policy dictates that participation in violent activities within the three-year threshold may be interpreted as active involvement. Despite this presumption, provisions exist for candidates to demonstrate tangible, positive behavioral changes during the intervening period. Additionally, administrative authorities have been instructed that pending character verification reports should not indefinitely delay the issuance of formal appointment letters, streamlining the onboarding process for successful candidates.

Political Opposition Alleges Overreach

The policy rollout has triggered sharp reactions from opposition parties. The Samajwadi Party (SP) strongly condemned the order, comparing its enforcement mechanism to colonial-era legislation.

SP spokesperson Udayveer criticized the decree, stating that such measures echo the British Raj. He emphasized that the constitutional right to peaceful protest remains fundamental in independent democratic India, arguing that regime changes occur through established legal electoral processes rather than arbitrary administrative profiling.

Similarly, senior Congress leader Rashid Alvi labeled the guidelines excessive and maintained that executive authorities were overstepping their jurisdiction by acting in a judicial capacity. He contended that the timing of the policy reflects an administrative apprehension regarding contemporary youth-led demonstrations.

Daily News 365 will continue to monitor the legal and political developments surrounding the implementation of these new recruitment rules across Uttar Pradesh administrative departments.
