New Legal Battle Unfolds

Former Federal Bureau of Investigation Director James Comey is facing a fresh criminal indictment accusing him of disclosing national defense information, marking the third legal case brought against the outspoken critic of US President Donald Trump.

According to a criminal complaint unsealed on Monday, the charges stem from an alleged communication in October 2016—while Comey was still heading the bureau—to an individual deemed "not entitled to receive it." Prosecutors allege Comey directed an unidentified person to pass national defense information to a national news reporter.

A History of Contentious Proceedings

The latest filing deepens an increasingly bitter legal and political conflict between the Justice Department and the former FBI chief. Comey was previously charged in September 2025 with making false statements to Congress and obstructing a congressional proceeding. That case was ultimately dismissed by a federal judge who ruled that the US attorney appointed by Trump to bring the charges had been unlawfully seated.

In April, Comey faced a separate indictment alleging he threatened the president's life via a social media post displaying numbers spelled out in seashells. The Justice Department interpreted the numeric symbols as a violent threat against the nation's chief executive, an allegation Comey has firmly denied.

Responding to the latest accusations via a video posted to his Substack, Comey dismissed the development. "It would almost be funny if it weren't such an appalling abuse of the Department of Justice," he said. "I'm still innocent. I'm still not afraid of these people, and I still believe in the independent federal judiciary."

Defense and Related Rulings

Defense counsel Patrick Fitzgerald pointed out that the matters underlying the latest indictment had already been thoroughly investigated during the first Trump administration, at which time government prosecutors concluded no charges were warranted. Fitzgerald emphasized that Comey maintains his complete innocence.

The unsealing of the latest court documents coincided with a separate federal ruling favorable to the Comey family. US District Judge Jesse Furman ruled that the July 2025 dismissal of Comey's daughter, Maurene Comey—a former federal prosecutor in New York—was unlawful. Judge Furman found that she had been stripped of her due process rights and ordered her immediate reinstatement following a lawsuit alleging she was targeted due to her father's political stances.
